Wi-Fi Terms and Conditions
The City Redondo Beach (hereinafter “City”) provides free wi-fi internet access to the public (hereinafter "Service"). Service access is permitted for personal use, subject to the following terms and conditions, which constitute a binding agreement between you and the City. Use of the Service constitutes acceptance of the terms and conditions contained herein.
ACCEPTABLE USE
You are expected to use the Service in a legal and responsible manner. By using the Service, you acknowledge that you agree to abide by all laws, and all federal, state and local rules and regulations. You also agree to not violate any rights of the City, its Hosts, or any third party. Examples of improper activities include, without limitation:
- The transmission or receiving of any pornographic, obscene or profane materials.
- Modifying, adapting, translating, or reverse engineering any portion of the City's digital network infrastructure.
- Attempting to break security, access, tamper with or use any unauthorized areas of the City's digital network infrastructure.
- Attempting to collect or maintain any information about other City Service users (including usernames and/or email addresses) or other third parties for unauthorized purposes.
- Accessing illegally or without authorization computers, accounts, equipment or networks belonging to another party, or attempting to penetrate security measures of another system. This includes any activity that may be used as a precursor to an attempted system penetration, including, but not limited to, port scans, stealth scans, or other information gathering activity.
- Creating or transmitting unwanted electronic communications such as "spam," or bulk commercial messages to other users or otherwise interfering with other user's enjoyment of the service.
- Engaging in any activity that infringes or misappropriates the intellectual property, publicity, privacy or other proprietary rights of others, including patents, copyrights, trademarks, service marks, trade secrets, or any other proprietary right of any third-party.
- Using the Service to transmit, post, upload, or otherwise make available defamatory, harassing, abusive, or threatening material or language that encourages bodily harm, destruction of property or harasses another or that is defamatory, objectionable, unlawful or promotes or encourages illegal activity.
- The transfer of technology, software, or other materials in violation of applicable export laws and regulations, including but not limited to, the U.S. Export Administration Regulations and Executive Orders.
- Distribution of any internet viruses, worms, pinging, flooding, mail bombing, denial of service attacks, defects, Trojan horses or other items of a destructive nature.
- Forging or misrepresenting message headers, whether in whole or in part, to mask the originator of the message.
- The sale, transfer, or rental of the Service to customers, clients or other third parties, either directly or as part of a service or product created for resale.
- Using the Service in violation of applicable laws and regulations, including, but not limited to, advertising, transmitting, or otherwise making available Ponzi schemes, pyramid schemes, fraudulently charging credit cards, pirating software, or making fraudulent offers to sell or buy products, items, or services.
The City may, in its sole discretion, opt to terminate the Service, your access to the Service, and/or revise the Terms and Conditions at any time, for any reason, without notice and without liability to you or any third-party.
NO RIGHT TO PRIVACY
The City reserves the right to cooperate with legal authorities and/or injured third parties in the investigation of any suspected crime or civil wrong in compliance with applicable laws and regulations. Such cooperation may include, but shall not be limited to, providing your name and email, and monitoring your Service access and internet use in compliance with applicable law.
SERVICE LIMITATIONS
The City does not guarantee any level of quality of service and may restrict access to the Service, limit the bandwidth available to any user or group of users and restrict usage at any time. The running of programs by a single user, or group of users, that may substantially degrade the Service performance or accessibility will not be allowed. High bandwidth operations, including but not limited to, downloading large files, gaming, and media sharing with peer-to-peer programs is also prohibited.
SECURITY
The City does not guarantee the security of the Service nor the privacy of your data and communication while using the Service. You should adopt appropriate security measures when using the Service. You must be aware that as you connect your device(s) to the Service, you risk exposing the device(s) to worms, viruses, Trojan horses, denial-of-service attacks, intrusions, packet-sniffing, and other abuses by third-parties. The onus is on you, to provide security measures to safeguard data. It is recommended that you take steps to protect your device(s), such as installing current anti-virus software and maintaining appropriate firewall protection. The City also assumes no responsibility for computer configurations, or the security of changes to data files resulting from connecting to the Service. If you have problems accessing the internet via the Service, City Staff will not provide technical support or troubleshooting for internet access/hardware/software on your personal device(s).
DISCLAIMER
By accessing this Service you acknowledge the disclaimer and release the City from any liability that may arise from your use of the Service. You acknowledge that: (i) the Service may not be uninterrupted or error-free; (ii) viruses or other harmful applications may travel through the Service; (iii) City does not guarantee the security of the Service and that unauthorized third parties may access your computer or files or otherwise monitor your connection; (iv) City could not provide the Service without charge without the limited warranty, disclaimer and limitation of liability specified herein, and it would require a substantial charge if any of these provisions were unenforceable; (v) you will refrain from using the Service to view obscene, offensive, harmful, or illegal materials prohibited by law; and (vi) your use of the Service is subject to the terms and conditions contained herein.
THE SERVICE AND ANY PRODUCTS OR SERVICES PROVIDED ON OR IN CONNECTION WITH THE SERVICE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND. ALL WARRANTIES, CONDITIONS, REPRESENTATIONS, INDEMNITIES, AND GUARANTEES WITH RESPECT TO THE CONTENT OR SERVICE AND THE OPERATION, CAPACITY, SPEED, FUNCTIONALITY, QUALIFICATIONS, OR CAPABILITIES OF THE SERVICES, GOODS OR RESOURCES PROVIDED HEREUNDER, WHETHER EXPRESS OR IMPLIED, ARISING BY LAW, CUSTOM, PRIOR ORAL OR WRITTEN STATEMENTS, OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO ANY WARRANTY OF SATISFACTORY QUALITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, ARE HEREBY OVERRIDDEN, EXCLUDED, AND DISCLAIMED.
INDEMNIFICATION
You agree to hold harmless and indemnify the City, its officials, officers, employees, agents, volunteers, affiliates, and contractors from and against any claim arising from or in any way related to your use of the Service, any materials downloaded or uploaded through the Service, any actions taken by you in connection with your use of the Service, any violation of any third party's rights or any violation of law or regulation, or any breach of this agreement. This shall include, but not be limited to, any claim, liability, loss, damage, cost, or expense, suits, judgments, litigation costs and attorneys' fees, of every kind and nature. Under no circumstances, shall the City be liable for any direct, indirect, incidental, special, punitive or consequential damages that result in any way from your use of or inability to use the Service or to access the internet or any part thereof, or your reliance on or use of information, services or merchandise provided on or through the Service, or that result from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation, or transmission, or any failure of performance.
SEVERABILITY
The foregoing shall be governed by and construed in accordance with the State of California, without effect to its conflict of laws provision If for any reason a court of competent jurisdiction finds any provision or portion of the foregoing to be unenforceable, the remainder of the foregoing shall continue in full force and effect.
